By using momentousgifts.com or purchasing a song, you agree to these terms. Please read them before you buy.

What Momentous Gifts does

You answer questions about someone you care about. Our AI tools write custom lyrics and produce a song from your details. You get a private gift page with the full song, an MP3 download, and a karaoke style lyric video. You can also add a photo with a date and note (included free) or a video letter with up to 20 photos, dates, captions, and notes ($29).

How it works

1. You answer questions about the person (name, relationship, occasion, memories, style, mood, voice, pronunciation).
2. AI writes the lyrics and produces the song.
3. You give your email to hear a free preview.
4. You pay $39 to unlock the full song on a private gift page.
5. Optional: pay $10 extra for 1-hour delivery instead of standard delivery.
6. Optional: add a video letter for $29.

Delivery

Standard delivery is within 24 hours of your order. If you choose 1-hour delivery ($10), your song will be ready within 1 hour.

The Love It Guarantee (refunds and redos)

We want you to love the song. Here is how our guarantee works.

Before the MP3 is downloaded:

• You get unlimited free redos. We make a new version of your song at no charge.
• You can make up to 5 new versions a day. After 15 versions, reply to your song email and we will make more with you.
• If you are still not happy, you can request a full refund within 7 days of purchase.

After the MP3 is downloaded:

• Downloading the MP3 (by you or by anyone you shared the gift page with) makes the song final.
• No refunds and no more redos after a download.

Video letter refunds:

• You can request a refund on the video letter within 7 days of purchase if you are not satisfied. Refunding a video letter removes it from the gift page.

How refunds work:

• Refunds go back to your original payment method.
• Allow 5 to 10 business days for the refund to appear.
• When a song is refunded, the song and gift page are turned off.

Your license to the song

When you purchase a song, you get a personal, non-commercial license. That means you can:

• Keep, play, and share the song with friends and family
• Post it on your personal social media
• Download and save the MP3

You may not:

• Sell or resell the song
• Use it in ads, commercials, or business promotions
• Distribute it on streaming platforms (Spotify, Apple Music, and others)
• Use it for any other commercial purpose

Our use of your content

We will not use your song, story, or photos in our marketing without your permission.

What you promise us

By using Momentous Gifts, you agree that:

• You have the right to share the names, stories, and photos you give us
• You will not submit content that is hateful, sexually explicit, harassing, defamatory, or that infringes on someone else's rights
• You will not request an imitation of a specific famous artist's voice or style
• You will not submit famous copyrighted lyrics or songs for recreation

We may refuse or remove any content that breaks these terms.

AI disclosure

Songs on Momentous Gifts are written and produced using AI tools based on the details you provide.

• Results vary. Every song is unique, but we cannot guarantee any specific outcome.
• Pronunciation of names may not be perfect on the first try. You can request a redo.
• We do not guarantee that a song will sound like any particular artist.

Payment and taxes

All payments are processed securely through Stripe. We never see or store your card number. Applicable taxes are calculated and collected by Stripe at checkout.

Privacy

Your use of Momentous Gifts is also governed by our Privacy Policy.

Disclaimers

Momentous Gifts is provided "as is" and "as available." We do our best to make great songs, but we do not guarantee that the service will be uninterrupted, error free, or that every song will meet your expectations. That is why we offer the Love It Guarantee above.

To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent allowed by law, Momentous Gifts and its owners, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

Our total liability to you for any claim related to the service is limited to the amount you paid us in the 12 months before the claim arose.

Governing law

These terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules. Any disputes will be resolved in the courts of Wyoming.

Changes to these terms

We may update these terms from time to time. When we do, we will post the new version with a new effective date. Your continued use of the site after changes means you accept the updated terms.
